Abstract:The paper examines one of the critical issues in the land tenure of Tanzania and of how foreigners may access and hold land in the country. Land occupation by foreigners (non-natives) has always been a concern of citizens (natives) from colonial times to date. The recent court decisions highlight some of the tensions. Two cases are analyzed and offer discussions of other wider policy objectives such as attracting foreign investors to Tanzania. The paper shows the dynamics and position of the old and current law and policy on the rights to occupy land by non-natives and discusses the possibility to allay concerns as to whether the existing laws are satisfactory pursuant to the existing national policy.
