Abstract:The approach followed in this book can be defined as a value-oriented or normative approach in terms of which (positive) constitutional law is not studied descriptively (uncritically) only, but is evaluated by means of (higher) legal values, i.e. those based on the libertarian Western tradition. Cases up to and including the South African Law Reports of September 1987 have been taken into account. Appendix: Republic of South Africa Constitution Act 110 of 1983.
