| Abstract: | The situation in Nigeria where an improver of land is not allowed to receive restitution under any circumstance for improvements made to land mistakenly under the principle 'quic quid plantatur solo, solo cedit', is unjust. The author argues that where the improver - not a meddlesome intervener - has made an honest mistake, and where the owner of the land has derived substantial benefit from the improvements, the improver should be allowed restitution for his improvements. The question should be: what is the best method by which a restitution is technically achievable? Notes, ref. |
