Abstract: | It is common knowledge that Malawi is a strong member of two regional organizations, namely, the Preferential Trade Area (PTA) and the SADCC. The principal aim of both of these organizations is the enhancement of trade among the member States. Increased trade among the member States will naturally mean that disputes of an international nature will arise beteen the contracting parties. One method of dispute settlement is by arbitration. This article examines the Malawian Arbitration Act. It starts with a detailed analysis of the provisions of the Act. Referring to decided cases, the author thereupon discusses how the Act is applied in practice. Finally, he poses the question as to whether the Act is suitable for the determination of international commercial disputes, and if it is not, what can be done to rectify the situation. Ref. |
