Abstract: | This paper examines the problem of conflict of laws in the case of employment contracts concluded with foreign nationals working in Ethiopia. Because of the absence in Ethiopia of Conflict of Laws Rules, it is difficult to determine which of the laws dealing with employment contracts should be resorted to as a governing law. The author is in favour of the application of the 'lex loci laboris' as a governing employment law. The 'lex loci laboris' guarantees the determination of the labour law relations in conformity with the principles and rules of a social and legal system to which the legal relation is socially and economically most related. Besides, the application of the 'lex loci laboris' avoids discriminatory treatment of employees working for the same employer, in the same area, or in the same country. However, some special types of employment may be subjected to other employment laws. The author mentions in particular diplomatic missions and consulates, the crew of ships and aircraft, and employment contracts for a short period of time or for a specific job. Notes, ref. |
