Abstract:This paper examines the implications of the doctrine of sovereign immunity in the context of international commercial arbitration. The focus is on the experience of Nigeria and the impact of the doctrine on the operation of Nigeria's treaty obligations in the area of international commercial arbitration. The paper also discusses the evolution of the doctrine of sovereign immunity, highlighting the landmarks that have had a sustained impact on international arbitral and judicial processes. The impact of case law and legislative developments in Europe and America are also examined, especially as they have affected and may continue to affect the fortunes of Nigeria and other developing nations in international commercial arbitration.
