Abstract: | The problem of squatter development in the urban areas of Tanzania entails both policy and legal considerations. The author outlines the problem and how the government has tried to deal with it, from the slum and squatter eradication policy it pursued in the 1960s, to the sites and services and squatter upgrading approach to the improvement of housing conditions in urban areas it adopted in 1972. Despite an apparent recognition at the level of policy of 'squatter rights', there is a glaring absence of legislative protection of squatters. At the same time, the reading of the legislation governing the granting and disposal of titles over land and the 1986 Court of Appeal decision in the case of Nyagwasa v. Nyirabu indicate that the residents of slum areas in towns and cities in Tanzania may not necessarily be squatters within the meaning of the law and may therefore have legal rights over the land either under customary law or by prescriptive titles.
