Abstract:This paper discusses rulings of the Court of Appeal of Tanzania made in applications under the Tanzania Court of Appeal Rules, 1979, notably applications for extension of time to institute appeal, for leave to appeal to the Court of Appeal, for discharge or reversal of decision of a single judge of the Court, for leave for fresh evidence, for directions, and for revision of High Court judgment/order. The paper also discusses the stand of the Court on instances of non-compliance with the Rules, such as appellant's failure to serve the memorandum and record of appeal on the respondent within 7 days after the judgment of the appeal, and appellant's failure to include the decree or exhibits in the record of appeal. The Court has, at times, shown extreme rigidity by requiring strict compliance with the provisions of the Rules at the expense of justice. Ref.
