Abstract:Since its establishment in 1979 the Court of Appeal of Tanzania has delivered several decisions which are landmarks in land law. The author discusses these decisions and their limitations and points out possible directions for future development of the law. The points dealt with can be summarized as follows: 1. Harmonization of the granted right of occupancy and the 'deemed' or customary right of occupancy. 2. Subsistence of the 'deemed' right of occupancy in planning areas of townships, municipalities and the City of Dar es Salaam. 3. Extinction of land rights on adoption of planning schemes in planning areas. 4. Application of customary law to disputes relating to urban land. 5. Requirement of approval for dispositions of rights of occupancy. 6. Exercise of Presidential power to revoke the granted right of occupancy. Notes, ref.
