Abstract:The Southern African Customs Union (SACU) consists of Botswana, Lesotho, Swaziland (the BLS States) and South Africa and dates back to an agreement reached in 1910. After the advent of political independence for the BLS States in 1966, the agreement was replaced by a renegotiated agreement in 1966. Although paragraph 3 of article 15 of the agreement allows for all the member States to have a fair chance to compete in the transport market of the common customs area, this market is currently dominated by South African operators. BLS operators are not able to compete with South African operators. To solve this problem, the author suggests a functionalist approach, combined with the introduction of harmonization. This would at least result in more proactive, informed involvement in the common transport problems of the SACU and might, to a certain extent, lead to the depoliticization of the technical field.
