Abstract: | The Treaty on the Lesotho Highlands Water Project was signed on 24 October 1986 in Maseru, Lesotho, on behalf of the governments of South Africa and Lesotho. This article considers the underlying principles of the agreement against the backdrop of a review of the status of the law on the nonnavigational uses of international watercourses. Then it examines briefly the historical and geographical context of the project, whose main object is to transfer water from the catchment of the Senqu River in Lesotho to the catchment of the Vaal River in South Africa. The salient aspects of the legal framework provided for in the main agreement between the two parties, together with its concomitant documents, are set out in more detail: the institutional arrangement, cost apportionment, the consideration to be paid by South Africa to Lesotho and finally, the measures instituted with a view to the prevention and settlement of disputes.
