Abstract:The strengthening and development of marine fisheries is of major significance in pursuing efforts to support Africa's economic development within the framework of the UN New Agenda for the Development of Africa in the 1990s (UN-NADAF). Almost all of Africa's 38 coastal States have promulgated laws on maritime spaces under their national jurisdiction within the new limits compatible with the 1982 UN Law of the Sea (LOS) Convention. The present article reviews the major initiatives on African fisheries taken within the United Nations system between 1990 and 1992 and discusses the implementation of the new fisheries regime in conformity with the LOS Convention through the subregional cooperative frameworks for fisheries development existing in West Africa, East Africa and the Mediterranean, as well as through the framework provided by the ACP-EC Lomé Conventions. Furthermore, it discusses problems arising from the LOS Convention, notably in regard to the enforcement capacities of African countries, the rights of landlocked and geographically disadvantaged States, drift-net fishing, and straddling and highly migratory fish stocks. In conclusion the author stresses the need for cooperation and recommends that donor funds be directed more to regional cooperation. Notes, ref.
