| Abstract: | This article concentrates on a neglected and largely undeveloped field of both public international law and law in general, namely the place and role of culture. More particularly, the place of cultural rights within the human rights system is examined. After a section on the various interpretations of 'culture', the article describes 'culture' in international human rights law; the tension between a cultural relativism approach, which sees human rights as relative to particular cultures and societies, and international human rights in terms of which human rights are universal; points of contact between culture and other fundamental rights; and the role of the South African judiciary in 'concretizing' culture.
