Abstract: | Under the auspices of the World Trade Organization (WTO) a Committee on Regional Arrangements has been established to examine the systemic effects of regional arrangements on international trade as well as to recommend ways to improve procedural mechanisms and ensure the compatibility of regional arrangements with multilateral rules. As SADC moves towards concluding a regional Trade Protocol, its members need to take account of the multilateral debate and the possibility of changes to the rules governing the formation of a free trade area. This paper aims at stimulating discussion in southern Africa on these issues by outlining existing rules and features of the current debate. It reviews the theory of regional integration, the key systemic trends and features of regional arrangements, the legal provisions on regional integration contained in the WTO agreements and emerging recommendations to clarify those provisions, and the key objectives of the proposed SADC Trade Protocol. The paper concludes by outlining the possible elements of a SADC approach when the Trade Protocols are notified to the WTO. Bibliogr., notes. |
