Abstract:The changes introduced in 1992 to the Botswana labour law and industrial relations system were aimed at shifting labour relations to the marketplace. More than ever before, collective bargaining will play a significant role in the determination of wages, and the terms and conditions of employment. The present article offers a critical assessment of the extent to which the law in Botswana affects the ability of workers to form and join independent and effective trade unions, a sine qua non for effective collective bargaining. Specifically, it examines legislation relating to the independence of trade unions; trade union recognition for collective bargaining purposes; disclosure of bargaining information; protection of union members from refusal of employment, action short of dismissal, and dismissal on grounds of union membership; and time off for trade union duties. It argues that some aspects of the constitution and of labour statutes unduly restrict workers' freedom of association. It concludes by calling for a new system of labour law, whose major purpose would be the protection of workers, their trade unions, and their representatives. Notes, ref., sum. (p.II)
