Abstract: | The discussion is limited to an examination of the attitude of the High Court of Tanzania to the application of customary law, with special emphasis on the manner in which it has sought to control such application. In the first section the author looks into the question of judicial manipulation of customary law (basis, the judicial techniques used, and the policies that influence the court's discretion). The concluding section picks up some of the implications of the preceding analysis of judicial activity for the attainment of national policy goals, and, specifically, the place of customary law in the national legal scheme.
