Abstract: | From the judgements recently handed down by the Court of Appeal for Eastern Africa in the case of 'The Kabaka's Government v. Musa N.S. Kitonto', the author offers his comment on the following aspects 1. The evolutionary nature of customary law; 2. The principles governing transfer of proceedings from the High Court to the Principal Court under the Buganda Courts Ordinance; 3. The current juristic basis for the application of customary law by the High Court in its original jurisdiction. |
