Abstract:When a husband in Ghana dies without leaving a will, it happens that his relatives immediately come and take away all his properties. Marriage under the Marriage Ordinance has not been an effective shield against unwarranted harassments by these relatives despite the efforts of that enactment to protect such widows and their children. This article examines how the courts have set out to grapple with the widow's plight, and if there are any other means of stopping this social evil. Sections: applications for letters of administration - Protection under the Ordinance - Problems of distribution - Stretching the law - The position at customary law - Need for reform. Notes.
