Abstract:The 1971 Advisory Opinion of the International Court of Justice (Legal consequences for States of the continued presence of South Africa in Namibia (South West Africa) notwithstanding Security Council Resolution 276(1970) shows more than ever the conflict between positivist and sociological interpretation of international agreements and documents. Behind the jurisprudential gymnastics the opinion shows the contradiction between decolonisation and colonisation in international law. The author surveys the instant opinion as a whole; in the same article a skeleton background is provided of all the previous South West Africa cases. However, the author has concerned himself only with the conflict between decolonisation and colonisation in international law. Notes; tables.
