Abstract: | In The People v. Chitambala, the accused, at the time a cabinet minister in the government of the Republic of Zambia, was charged with the offence of bigamy. The accused's defence was that he had divorced his wife under customary law. He thought that a marriage under the Marriage Act could be dissolved under customary law. He thus contended that he was not criminally responsible for his act as he honestly believed, albeit mistakenly, that facts which would enable him to marry again were in existence. The accused was convicted as charged. The author comments on the judge's considerations. Notes. |
