Abstract: | This article examines and evaluates certain aspect of the reasoning adopted by the International Court of Justice in its advisory opinion of 21-6-1971, given in answer to the question posed by the Security Council in its resolution 284 (1970): 'What are the legal consequences for States of the continued presence of South Africa in Namibia, notwithstanding Security Council resolution 276 (1970)?' It is this advisory opinion which formed the legal platform for subsequent United nations action, including Security Council resolution 385 of 30-1-1976, attempting to wrest control over S.W.
