| Abstract: | By virtue of sovereignty a state as a member of international communty is free to grant extradition of a person, who has sought asylum in its territories, as a matter of courtesy, goodwill and mutual convenience to the demanding state in order to preserve international peace and security in the absence of any treaty arrangement with the requesting state. It is also free under the same notion to deny extradition if any of the substantive or forrnal conditions of the practice are not met. In addition extradition shall also be denied by reason of existence of specific exclusions and defences arising out of treaty or customary practice. Those grounds of denial can be grouped in four categories depending upon 1) the nature of the crimes charged, 2) penalty of punishment attached to the offence, 3) the nationality of the person involved, 4) the technical legal defences which can be invoked by the accused.
