Abstract: | The Fatal Accidents Act, introduced in the United Kingdom in 1846 a legislation whereby certain relatives of a person killed by the tortious behaviour of another could claim some compensation calculated according to the degree of their dependence on the deceased, formed the basis of the Kenya Act of 1946, the Uganda Act of 1953 and the Tanzania Act of 1955. These three Acts in East Africa are not, identical, and addtional alterations in the U.K. have put their law in a different position from all these acts. The differences are to be found in the class of dependants who can bring a claim under the relevant acts also the type of deductions that can be made from the award. Sections of the article: Introduction (Kenya; Tanzania) - The degree of dependency (Death of husband and father; Death of wife and mother; Death of child) - deductions - Conclusion. Notes. |
