Abstract:This paper looks at the problems of recidivism and considers whether the penal system makes any meaningful provisions for the recidivist. The Punishment of Habitual Criminals Act, 1963 (Act 192) is discussed. The purpose of the Act is both punitive and reformative. Objections to this approach are that the legislation does not differentiate between the various types of habitual offenders and that the regime of preventive detention does not reach the type of offender for whom special sanctions might be appropriate. There has been no attempt so far at evaluating the efficacy of imprisonment within the penal system in Ghana and specifically of preventive detention for habitual offenders within the system. What is needed is a proper review of penal policy as a whole and a consideration of possible alternatives to the present system. Notes.
