Abstract: | The Status of the Transkei Act, 100 of 1976, makes provision for categories of persons who will be citizens of an independent Transkei and who cease to be South African citizens Article 6(2) of this act provides that: 'In the event of doubt as to whether or not any person falls in any of the categories of persons... any authority in the Republic or in the Transkei may refer the matter to a board to be estabished as agreed upon between the Prime Minister of the Republic (of South Africa) and the... Prime Minister of the Transkei...' This board will have a dual nature. It will be established by the prime ministers of two independent states; on the other hand, its basis will be a South African statute and not a treaty. This is discussed in the article. Ref. |
