| Abstract: | The Criminal Code in Nigeria is an example of a statute which has received much less attention than it deserves and which ahs often been worsted at the hands of the Common law. The article examines one aspects of the Criminal Code - the law of provocation - with especial reference to the way in which the courts have treated the Code and the common law. Therefore it examines first the rules according to which the C.C. ought to be interpreted; secondly the defence of provocation and thirdly the plea of provocation. To clarify this third topic the article examines the sources of the law of provocation. |
