Abstract: | In 1994 a new Companies Act was enacted in Zambia. This statute changed company law in Zambia fundamentally. Among the changes was the introduction of statutory provisions instituting restrictions on financial assistance in the acquisition of company shares. The present article (of which a version was read at the Faculty of Law, University of Zimbabwe, Harare, in February 1997) examines the salient features of the law restricting financial assistance in the acquisition of company shares. It examines the efficacy of the law in Zambia and considers distinctions and similarities between the Zambian system and those of the United Kingdom and South Africa. Notes, ref. |
