Abstract:During the last three years, and particularly since the Accord of Nkomati was signed by the governments of South Africa and Mozambique on 16 March 1984, there has been a steady flow of refugees across Mozambique's borders into South Africa. They are treated by the South African authorities as illegal immigrants. Immigration officers are entitled to detain them and summarily repatriate them. This article deals with the principle of non-refoulement, the refugee status of people entering South Africa from Mozambique, and South Africa's responsibility. Notes, ref.
