Abstract: | During the colonial period the question was debated: should the general (English-based) law of succession apply to Africans at all, even if married under the Marriage Ordinance? This controversy first indicates the wide divergence in attitudes between the legal officer and the administrative officer during the period when indirect rule was the administrative officer's philosophy; 2. it shows the wide gulf between the Muslim and pagan provinces of the north and those of the south; 3. underlines the divergence between fact and theory as to what the law actually in operation was. Quoting at some length from the secretariat files of that time, the author examines this issue. |
