Abstract: | In recent years petty statutory offences have multiplied to such an extent that it has become obvious that the police cannot be expected to prosecure every offence of which they become aware. In deciding whether to arrest and whether to prosecute the police must therefore exercise a discretion. Drawing on American and British research, the author examines the grounds on which this discretion tends to be exercised and argues that police training ought to acknowledge its existence and prepare policemen to exercise it along sound policy lines.
