Abstract: | When the arrest of 3 leaders of the National Democratic Party on July 19, 1960, was followed by demonstrations in the African townships of Salisbury, the Prime Minister declared in the Legislative Assembly on July 20, 'That the normal processes of law were followed'. But the due process of Law and arbitrary action by the government are not necessarily incompatible under the statute law of S. Rhod. The unlawful organisations Act, 1959, the Preventive Detension (Temporary Provisions) Act, 1959, the Subversive Activities Act, 1950, and the Public Order Act, 1955, permit the government, in effect arbitrary, to curtail the fundamental liberties of the individual to a considerable degree. |
