Abstract:Although in almost all the former British African territories the colonial power tried to make use of the traditional dispute settlement agencies, little is known of the way in which these agencies actually reacted towards this process of incorporation. Have they remained the agencies to which Africans actually resorted for the settlement of their disputes? Similarly little is known about those agencies, typically at the lower levels, which did not undergo incorporation. The Tswana customary courts in Botswana with their highly sophisticated judicial systems are used by the author for research along these lines. The records kept in these courts during 19617O provide the basis of the present article in the following parts; The process of recognition - The work of the Chief's courts - The courts below the Chief - The future of the Tswana customary courts. Tables; résumé en français.
