Abstract: | The Tribal Courts (Dare) were legality recognised under the Native Law and Courts Act, 1937. Their jurisdiction of customary law was defined in the African Law and Tribal Courts Act of 1969. The scope and limitations of such law is well documented in B. Goldin and M. Gelfand, 'African law and custom in Rhodesia' (1975). The Dare Record Case Books of two chiefs, Chief Nyajina of Mrewa and Chief Chiota of Mtoko, were examined in order to find the most commonly presenting offences at the tribal courts in these areas, and whether any change occurred in the pattern of these offences over time. The Dare Record Case Books of Chief Nyajina were examined for the years 1936-1941, 1955 and 1964-1967. Chief Chiota's Dare Record Case Books were examined for the years 1967-1971. The results are presented in tables and figures. Fig., tab., ref. |
