Abstract:The Mines and Minerals Act (no. 33 of 1976) makes mandatory domestic participation a precondition for the establishment of any mining enterprise by foreign investors and the law fixes the terms of the domestic capital required. This article looks at the background to this policy decision, the terms of participation, the objectives of the policy and the state's prospects of realising these objectives in practice.
