Abstract:The article sets out the legal backgound to the case and it doesn't speculate on the possible outcome. From an examination of the course of the proceedings the conclusion emerges that the Court is required to decide on two sorte of issues: those concerned with the existence of the Mandate and the obligations of the Mandatory towards the United Nations; and those concerned with the practice of apartheid. The development of the 'Norm' argument as the sole basis for the Applicants' contentions on the second aspect seems to leave the Court with a claer-cut proposition, which it must either uphold or reject.
