Abstract:During 1950-52 the writer carried out an investigation of the customary law of marriage and landholding. In both these spheres, the customary law is changing in response to changes at work in the society at large. As in many African areas however there is no adequate means of assuring that a degree of consistency in the law is maintained in the course of change. Faced with new situations and new popular moral standards, different courts respond in different ways and the law thus tends to move indivergent directions.
