Abstract: | On account of a special case this note discusses the legal criteria of legitimacy in Ghana, and questions this aspect of the decision in that case. In determining who is legitimate the Ghanaian courts have not followed the old English rule that only the child born of a monogamous marriage was legitimate, they have argued that legitimacy is to be determined by the law of domicile in these cases the Ghanaian law, which includes customary law. This has led to a broadening of the concept of legitimacy, although doubt remains as to how far the development will go. Notes, ref. |
