Abstract:There are many situations in which a person may find himself possessed of a benefit which in fairness and justice he should not be allowed to retain. This paper examines whether the principle of unjust enrichment has also been accepted judicially in Nigeria. First it examines briefly the course of the doctrine through the centuries in most of the advanced legal systems of the world. In the conclusion the author poses that it is too premature to say that Nigeria has really accepted the principle of unjust enrichment. Parts: 1. The development of the doctrine - 2. Examination of the cases decided judicially - 3. Conclusion. Notes.
