Abstract: | When an ignorant tribesman murders a person he believes is a witch, the law is faced with a very considerable problem. It is obviously desirable to discourage belief in witchcraft but it is equally obvious that an accused in these circumstances cannot be regarded as if he were the normal reasonable man. The author considers the possible defences of self-defence, insanity, claim of right, mistake of fact and provocation and concludes with an examination of the appropriateness of a deterrent sentence.
