Abstract: | The Law of Succession Act has still not yet come into operation, largely due to the need to train the large number of officers necessary if implementation of the Act's provisions is to be effective. The Kenyan legislator has a firm belief in the power of legislation as an instrument to effect the swift demise of Customary Law and to foster new values more appropriate to the needs of a developing nation. The argument of this article is that such confidence is misplaced.
