Abstract:In traditional common law and customary law there is the presumption that a child born in wedlock is presumed legitimate, thus belonging to the husband of the marriage even though biologically, he may not. In this article the author examines the case for and against the use of scientific evidence in determining paternity vis--vis this legal presumption. finally he makes some recommendations for blood test evidence in Ghana.
