Abstract:This article re-examines the justification, if any, for withholding the status of legitimacy from an acknowledged child born in consequence of adultery committed during marriage, particularly when the existing marriage is one under the Marriage Act. Although attention is focussed mainly on Nigerian cases, some decided cases and writings on Ghana law, which reveal many points of common approach, are also discussed. The legislative trend in relation to adultery shows the changing attitude of society to adultery as a matrimonial offence. Notes.
