Abstract:After the commencement on 15 November 2000 of the Recognition of Customary Marriages Act, 120 of 1998, dissolution of a customary marriage in South Africa is possible only by a decree of court on the ground of the irretrievable breakdown of such marriage. This article examines the consequences of the dissolution of a customary marriage for the spouses and their children (questions about custody and maintenance), and the consequences in respect of matrimonial property (the division of the marital estate).
