Abstract:The proliferation of literary and artistic works in Eritrea and the increasing exposure, through modern media of communication, to similar foreign works brings with it questions on the legality of the means for procuring and distributing these works. The main issue concerns the authors' copyright. This article first discusses copyright and intellectual property from an international perspective. Then it outlines the constitutional and statutory foundations of authors' rights in Eritrea, the rights of authors under the 1991 Transitional Civil Code of Eritrea (TCCE), as well as limitations to authors' rights. The author argues that the now scanty provisions of the TCCE need to be updated and expanded in a number of areas. Bibliogr., notes, ref., sum. [Journal abstract, edited]
