Abstract:	Among the innovations introduced by the constitution of 18 february 2006, mention should be made of the inclusion of prosecutors in the number of holders of the judiciary. part of the doctrine has inferred that the controversy over the legal nature of the prosecutors' officers was closed in favor of the thesis of the magistrate's status. on 20 january 2011, the public prosecutor's office was removed from the judiciary. this resulted in the revival of the aforementioned controversy. the study contributes to this through a rigorous analysis of positive law.
