| Abstract: | Respect for all the requirements of the balance between the different protagonists of the trial is what gives rise to equal and equitable justice; for the work of justice owes its value to many factors. far from limiting itself to the task of saying the law, it is understood, and above all, in the very way of saying it. in congolese law, the bailiff has been given the task of signifying different exploits of justice, especially the assignment. indeed, the congolese legislator added to the deadline of eight clear days provided for the appearance of the city to the court from its service, a period of distance of one day per hundred kilometers. we have criticized throughout this study because not only does it not reflect the congolese reality in this matter but also it does not give rise to equal and equitable justice. |
