Abstract:The right to development is one of the collective rights [third generation rights] constitutionalized in the DRC. Within the framework of the united nations, this right is at the center of the sustainable development goals (sdgs) and the development of the nations and human rights of which the right to development is a part, are the objectives of this organization. The development issue of the DRC has so far proven to be crucial, as the country is extremely rich in natural resources but its population very poor and exposed to several challenges that prevent integral, harmonious and sustainable development. As for the province of Haut-Katanga, the province is one of the best placed to initiate economic development not only for the present generations but also for future generations of all its communities, because it is globally endowed with natural resources. Without being excessive pessimistic, to ignore the efforts that the provincial government of Haut-Katanga is providing for the economic development of its province, there are challenges at its level to allow such a type of development. Thus, given that there is a strong correlation between the quality of public institutions and the economic growth of a society, this reflection addresses the issue of the contribution of public institutions to the economic development of the Haut-Katanga province, with a look discussion on the legal framework, the challenges and the prospects in the mining sector, which is today considered to be the main provider and the backbone of the Congolese economy.
