Abstract:The complexity and costs in terms of means and time of manual or paper ballot voting operations in modern democratic states make electoral organization and participation costly and weak. To make up for this situation, the election management bodies have revolutionized electoral materials and tools by introducing the voting machines or computer that facilitate electoral operations. Beyond their laudable progress, several problems and gray areas are hanging over their purchase and use thus requiring the intervention of the legal rules which frame them. It is with this in mind that this article aims to rationalize the voting machines introduced by ceni in the congolese electronic voting system by offering the legislator the track of the legal framework of these new electoral technologies so that the rules governing their use are equivalent to those which govern the manual voting or secret paper ballot process.
